The waiter who sued the now sober starlet claims in court papers filed yesterday that he has proof she had been boozing it up before she collided with his van in October 2005.
Raymundo Ortega, who is seeking $200,000 in damages, alleges LiLo drove her Mercedes-Benz into a van he was driving after she drank alcohol and later tried to escape paparazzi.
(Lindsay, who has countersued, contends Ortega caused the crash by making an illegal U-turn in Beverly Hills.)
What could this proof be?!? A witness? Booze breath? Empty bottles in her car? We’ll find out when the case goes to trail in 2008.

The receipt shows 4 drinks ordered & 5 people dining … The bill was split between 3 different credit cards so she maynot have paid for it. This dude doesnt stand a chance.

Kate, the Ivy is a restaurant, and this incident happened in the middle of the day. I agree with you about Hollywood clubs serving underage famous people, but this wasn’t an instance of that happening.
